Our services may include:

  • Online courses and tutorials.

  • AI-powered creative tools and educational resources.
  • Premium Golden Tips and exclusive learning content.
  • LUTs, presets, templates, VFX elements, plugins, and other downloadable digital products.
  • Memberships, subscriptions, certificates, and other platform features.

These Terms and Conditions govern your access to and use of the Xkills website, applications, digital products, and related services.

By accessing or using Xkills, creating an account, purchasing a product, or subscribing to a service, you agree to these Terms and Conditions. If you do not agree, you must discontinue using the relevant services.

2. Eligibility and User Accounts

To use Xkills, you must provide accurate and complete information when creating your account.

You agree to:

  • Provide truthful registration and payment information.
  • Keep your login credentials confidential.
  • Maintain the security of your account.
  • Notify Xkills promptly if you suspect unauthorized access.
  • Accept responsibility for activities conducted through your account, subject to applicable law.
  • Update your account information when necessary.

You must not create accounts using false identities, impersonate other people, or use another person's account without authorization.

Xkills may suspend or restrict accounts involved in fraud, unauthorized access, payment abuse, intellectual property infringement, or other violations of these Terms.

Users under the age of 18 must use Xkills with any parental or guardian consent required by applicable law.

3. Use of the Platform

Xkills grants you a limited, personal, non-exclusive, non-transferable right to access and use the platform for lawful purposes, subject to these Terms.

You agree not to:

  • Use Xkills for illegal activities.
  • Attempt to hack, disrupt, damage, or gain unauthorized access to the platform.
  • Copy, redistribute, resell, or commercially exploit Xkills content without permission.
  • Circumvent payment systems, access restrictions, or subscription controls.
  • Upload malware or content intended to compromise platform security.
  • Misrepresent your identity or affiliation with Xkills.
  • Interfere with other users' access to the platform.

We reserve the right to investigate suspected violations and take proportionate action in accordance with applicable law.

4. Courses and Educational Content

Xkills offers educational content to help users improve their creative and technical abilities.

Courses may cover software and disciplines such as Adobe Premiere Pro, DaVinci Resolve, After Effects, Photoshop, filmmaking, color grading, AI content creation, and other creative fields.

Unless expressly stated otherwise:

  1. Courses are educational resources and do not guarantee employment, income, professional recognition, or specific results.
  2. Course availability, structure, instructors, and materials may change over time.
  3. Access conditions depend on the product purchased or the membership plan selected.
  4. Course completion requirements may vary by course.
  5. Users are responsible for ensuring that their devices and software meet the requirements for accessing course materials.

Xkills may introduce new courses, features, and learning formats at its discretion.

5. Purchases and Digital Products

Xkills may sell individual courses, learning resources, Golden Tips, LUTs, presets, templates, plugins, VFX packs, and other digital products.

Before purchasing, you should review the product description, price, included features, file formats, compatibility requirements, and any applicable usage restrictions.

When purchasing a digital product:

  • You receive the specific access rights or licence described on the product page.
  • You do not acquire ownership of the underlying intellectual property merely by purchasing access.
  • Download availability and future access depend on the product terms and technical limitations disclosed by Xkills.
  • You must not redistribute, resell, share, or publicly upload purchased products unless expressly permitted by the applicable licence.

Some products may require third-party software, subscriptions, hardware, or compatible operating systems that are not provided by Xkills.

6. Pricing, Payments, and Taxes

Prices will be displayed at checkout or on the relevant product page.

Xkills may support payment methods such as mobile money, cards, bank transfers, and third-party payment providers, depending on availability.

By making a purchase, you authorize the applicable payment provider to process the transaction.

You acknowledge that:

  • Payments must be made through approved payment channels.
  • Access to paid content may be granted after payment has been successfully verified.
  • A payment confirmation from a bank or mobile-money provider does not necessarily mean that Xkills has verified the transaction.
  • Applicable taxes and additional charges will be disclosed where required.
  • You must not submit fraudulent payment confirmations or attempt to bypass payment verification.

If a payment is deducted but the purchased product is not made available, please contact Xkills support with your transaction reference.

Xkills will investigate the issue and, where appropriate, arrange access, correction, or a refund in accordance with applicable law and our refund policy.

7. Subscriptions and Memberships

Xkills may offer monthly, yearly, or other subscription plans, including premium memberships.

Subscription benefits may include access to selected courses, exclusive content, creative resources, premium features, and other benefits described in the relevant plan.

When subscribing, you agree to the price, billing frequency, duration, and renewal terms disclosed at checkout.

Unless the checkout page states otherwise:

  • A subscription provides access only to the benefits included in the selected plan.
  • Some products may require a separate purchase.
  • Subscription prices and benefits may change prospectively, subject to appropriate notice and applicable law.
  • Cancellation stops future renewals but does not automatically entitle you to a refund for a period already paid for.
  • Access after cancellation will continue until the end of the paid subscription period unless the plan states otherwise or access must be restricted for a lawful reason.

Where automatic renewal is offered, its terms must be disclosed before payment. Users must be given a reasonable means to manage or cancel their subscriptions.

8. Refunds, Cancellations, and Failed Transactions

Xkills aims to describe its products accurately and provide customers with a reliable purchasing experience.

Refund eligibility may depend on the type of product, delivery status, technical issues, duplicate payments, and applicable consumer protection laws.

You may request a review if:

  • You were charged more than once for the same purchase.
  • A verified payment did not result in the promised access.
  • A product is materially different from its description.
  • A technical problem prevents access and cannot reasonably be resolved.
  • A refund is otherwise required by applicable law.

For downloadable digital products and online courses, refunds may be restricted where lawful, particularly after content has been delivered, downloaded, or accessed. However, nothing in these Terms excludes any mandatory cancellation, refund, or consumer rights that apply to your transaction.

To request a refund, contact Xkills support with your account details, transaction reference, purchase date, and a description of the issue.

Refund requests will be reviewed individually. Where approved, refunds will generally be processed through the original payment method where practical and legally permissible.

Important: Xkills should publish a separate, detailed Refund Policy before accepting customer payments. Any statutory cancellation rights and applicable exceptions must be reflected in that policy.

9. Intellectual Property Rights

Unless otherwise stated, Xkills and its licensors retain ownership of the platform and its original intellectual property, including:

  • The Xkills name, logo, branding, and visual identity.
  • Website and application design.
  • Original course materials, videos, tutorials, and written content.
  • Original graphics, templates, presets, and other digital resources.
  • Platform software, features, and proprietary systems.

Purchasing a course or digital product does not transfer ownership of these rights to you.

You may use purchased materials within the licence provided for the relevant product. You must not reproduce, distribute, sell, sublicense, or publicly share protected materials beyond the scope of that licence.

Nothing in this section restricts rights that cannot lawfully be excluded.

10. Licence for Downloadable Products

Each downloadable product may have its own licence specifying permitted personal, educational, or commercial use.

Unless the product page or accompanying licence expressly permits otherwise, you must not:

  • Resell or redistribute the original files.
  • Upload the files to public download sites.
  • Share purchased files with people who have not obtained the necessary licence.
  • Repackage or sell the files as standalone products.
  • Claim another creator's original work as your own.
  • Remove copyright notices or licence restrictions.

Where a product includes third-party assets, fonts, software, AI-generated elements, or other licensed materials, additional third-party terms may apply.

If a product has a separate licence, that licence governs its specific usage rights and should be read together with these Terms.

11. User-Generated Content and Community Features

Xkills may allow users to submit comments, reviews, projects, portfolios, images, videos, course materials, or other content.

You retain ownership of the intellectual property rights you hold in your content.

By submitting content to Xkills, you grant Xkills a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute that content only as reasonably necessary to operate, provide, promote, and improve the services, subject to applicable law and any additional permissions you grant.

This licence does not transfer ownership of your content to Xkills.

You represent that you have the necessary rights and permissions to submit the content.

You must not upload content that:

  • Infringes another person's copyright, trademark, privacy, or other rights.
  • Contains unlawful threats, harassment, or abusive material.
  • Is fraudulent, deceptive, or malicious.
  • Violates applicable law or these Terms.

Xkills may remove or restrict content that violates these rules and may provide a process for reporting infringement.

12. Instructor and Creator Responsibilities

If Xkills enables instructors or creators to publish or sell courses and digital products, additional creator terms may apply.

Creators are responsible for:

  • Providing accurate course and product descriptions.
  • Obtaining the rights necessary to publish their materials.
  • Respecting applicable intellectual property laws.
  • Delivering content that meets Xkills' published standards.
  • Providing accurate information about product compatibility and usage rights.
  • Complying with applicable tax, consumer protection, and other legal obligations.

Commission rates, payouts, ownership arrangements, withdrawal rules, and other marketplace conditions must be set out in a separate Creator Agreement or Marketplace Policy where applicable.

Nothing in these Terms alone promises that any user will be accepted as an instructor or that any creator will earn a particular amount.

13. Certificates and Course Completion

Xkills may issue digital certificates to users who meet the completion requirements of eligible courses.

Unless explicitly stated otherwise:

  • Certificates confirm completion of the relevant Xkills course or learning activity.
  • Course-specific requirements may include completing lessons, assessments, projects, or other activities.
  • Certificates do not automatically represent government accreditation, a university qualification, a professional licence, or a guarantee of employment.
  • Xkills may verify certificate authenticity and correct certificates issued in error.

Users must not forge, alter, or falsely claim to have earned an Xkills certificate.

14. AI Tools and Third-Party Services

Xkills may provide access to AI-powered features or integrate with third-party services for image generation, video generation, editing, automation, and other creative workflows.

AI-generated results may be inaccurate, incomplete, similar to existing works, or unsuitable for a particular purpose.

You are responsible for reviewing generated outputs before using or publishing them.

You must ensure that your use of AI tools complies with applicable law, third-party service terms, and relevant intellectual property and privacy rights.

Xkills does not guarantee that AI-generated content is unique, copyrightable, commercially suitable, or free from third-party claims.

Third-party software, plugins, websites, and services may operate under their own terms and privacy policies. Xkills is not responsible for independent third-party services to the extent permitted by applicable law.

15. Privacy and Personal Data

Xkills may collect and process personal information such as account details, contact information, learning progress, purchase records, payment references, and technical information necessary to provide its services.

Personal information will be handled in accordance with the Xkills Privacy Policy and applicable data protection laws.

We may use relevant information to:

  • Create and manage user accounts.
  • Provide purchased courses and digital products.
  • Process and verify payments.
  • Issue certificates where applicable.
  • Provide customer support.
  • Maintain platform security and prevent fraud.
  • Meet legal and regulatory obligations.

Payment card or mobile-money credentials may be processed by external payment providers under their own applicable security and privacy arrangements.

Please review the Xkills Privacy Policy for details concerning data collection, use, retention, sharing, security, and applicable user rights.

16. Platform Availability and Technical Changes

Xkills aims to maintain a reliable platform but does not guarantee uninterrupted access or that every feature will always be available.

Temporary interruptions may occur due to maintenance, updates, network failures, security incidents, or third-party service disruptions.

We may modify, improve, suspend, or discontinue features when reasonably necessary.

Where a change materially affects a paid service, Xkills will take reasonable steps to communicate the change and provide any remedy required by applicable law or the relevant purchase terms.

Nothing in these Terms excludes liability for obligations that cannot lawfully be excluded.

17. Account Suspension and Termination

You may stop using Xkills at any time and may request account closure through the available account settings or customer support.

Xkills may suspend, restrict, or terminate an account where reasonably necessary because of:

  • Serious or repeated violations of these Terms.
  • Fraudulent payments or attempted payment circumvention.
  • Unauthorized redistribution of protected content.
  • Security threats or unlawful activities.
  • Legal or regulatory requirements.

Where appropriate and legally permissible, Xkills will provide notice and an opportunity to resolve the issue.

Account closure does not automatically cancel outstanding payment obligations or create a right to a refund. Any remaining access, subscription cancellation, refund, or data-retention arrangements will be handled according to the applicable product terms and law.

18. Disclaimers

Xkills provides educational content and creative resources for learning and professional development.

To the extent permitted by law, we do not guarantee that:

  • The platform will be continuously available or error-free.
  • Every course will produce a particular skill level or outcome.
  • A user will obtain employment, clients, income, or business success.
  • Every digital product will be compatible with every device or software version.
  • AI-generated results will meet every user's expectations.

The platform and its services are provided subject to the express commitments made in the applicable product description, purchase terms, and any mandatory legal requirements.

19. Limitation of Liability

To the extent permitted by applicable law, Xkills will not be liable for indirect or consequential losses arising from the use of the platform, including loss of anticipated profits, business opportunities, or data, where such exclusions are legally enforceable.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.

Where permitted by law, Xkills' liability relating to a particular paid product will be assessed in light of the circumstances, the applicable purchase terms, and the loss directly caused.

This section does not remove any mandatory consumer rights or remedies available to you.

20. Indemnity

To the extent permitted by law, you may be responsible for losses, claims, or reasonable costs directly arising from your unlawful conduct, your infringement of another person's rights, or your material violation of these Terms.

This provision does not apply to the extent that a claim results from Xkills' own unlawful conduct or where such an allocation of liability is prohibited by law.

21. Changes to These Terms

Xkills may update these Terms to reflect changes in its services, business operations, technology, or legal requirements.

The updated version will be published on the website with a revised effective date.

Where a change materially affects your rights or obligations, Xkills will provide appropriate notice where required by law.

Your continued use of the relevant services after the effective date of an update may constitute acceptance where legally valid. If you do not agree with a material change, you may stop using the affected services and exercise any applicable contractual or statutory rights.

22. Governing Law and Dispute Resolution

These Terms are intended to be governed by the laws of the United Republic of Tanzania, subject to any applicable mandatory legal requirements and consumer protections.

If a dispute arises, the parties should first attempt to resolve it through good-faith communication with Xkills support.

Where the dispute cannot be resolved informally, either party may pursue the remedies available through the appropriate competent court or dispute resolution body.

Nothing in this section prevents a consumer from exercising any mandatory rights available under applicable law.

23. Third-Party Trademarks and Software

Names and trademarks such as Adobe Premiere Pro, DaVinci Resolve, After Effects, Photoshop, Blender, and other third-party products belong to their respective owners.

References to third-party software are provided for identification, educational, or compatibility purposes only.

Unless expressly stated otherwise, Xkills is independent of those companies and is not officially endorsed by them.

Users remain responsible for obtaining any software licences required to use third-party applications.

25. Final Provisions

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Failure to enforce a provision does not automatically waive the right to enforce it later.

These Terms, together with the applicable Privacy Policy, Refund Policy, subscription terms, and product-specific licences, govern your use of Xkills.

Where a separate agreement applies to a particular product or service, the documents should be read together. Any conflict will be resolved in accordance with the applicable agreement and mandatory law.
